Traffic Accident in Spain: Your Rights as an Injured Party

Every year, many tourists and residents are involved in traffic accidents in Mallorca, Ibiza and mainland Spain.

First Steps After the Accident

  1. Request the accident report (Atestado) from the Guardia Civil or Policía Local
  2. Complete the European Accident Statement (Parte Amistoso) with both parties
  3. Document photos, witnesses and initial medical treatment
  4. Notify your own and the other party's insurer

Compensation Claims (Baremo)

Spain uses a legal scale system (Baremo de Tráfico) to calculate personal injury and property damage using fixed tables — including pain and suffering, loss of earnings and care costs.

Role of the Insurer

The at-fault driver's insurer must present an offer within 3 months. This is often far below the actual claim — legal review is worthwhile.

Limitation Period

Claims from traffic accidents in Spain expire after one year (civil liability), longer if criminal proceedings apply.

Conclusion

As a German-speaking lawyer I help accident victims obtain full compensation under the Baremo — including against Spanish insurers.
