Neighbour Disputes in Mallorca: Legal Basics
Many German owners in Mallorca end up in conflict with neighbours or the Owners' Community. Spanish condominium law (Ley de Propiedad Horizontal, LPH) regulates these cases in detail.
Common Disputes
- Unpaid community fees: the community can enforce via payment order proceedings (Proceso Monitorio)
- Illegal renovations: terrace glazing, pool construction without community approval
- Noise nuisance: under Art. 7.2 LPH, disruptive activities (e.g. holiday rentals with parties) can be prohibited
- Illegal short-term rentals: many communities ban Airbnb-style rentals via bylaw changes
The Owners' Assembly (Junta de Propietarios)
Assembly resolutions are binding. Anyone who disagrees can challenge them in court within 3 months (Art. 18 LPH).
Legal Action Against Disruptive Neighbours
For serious violations, the community can, after a warning, file a claim to prohibit use of the property (up to 3 years).
Conclusion
Neighbour conflicts in Mallorca can often be resolved with clear knowledge of the LPH and timely action. I represent you against the community or individual neighbours.
