Debt Collection in Mallorca – Your Path to Recovery

Pre-litigation Demand

Before initiating court proceedings, I always recommend sending an out-of-court demand letter (Burofax). In Spain, this has special legal significance as it documents both delivery and content.

Court Payment Order (Procedimiento Monitorio)

The Monitorio under Art. 812 ff. of the Ley de Enjuiciamiento Civil (LEC) is the fastest judicial instrument for debt collection in Spain:

• Competent court: Juzgado de Primera Instancia at the debtor's domicile
• No claim limit since the 2015 reform
• Court fees: Free up to €2,000
• Duration: Typically 2–4 months until enforcement

Enforcement (Ejecución)

After obtaining an enforceable title, compulsory enforcement can be initiated:

• Bank account seizure
• Property attachment (Embargo de bienes inmuebles)
• Wage garnishment
• Vehicle seizure
